These Pricing Terms and Conditions are offered by Snap Crackle and Pop Fireworks LLC, d/b/a Snap Crackle and Boom Fireworks, pursuant to the laws of Missouri. The pricing between our online store and our stands can vary. Pricing differences are common as we tend to run different specials for each platform based on the audience. These Pricing Terms and Conditions also govern your use of the Website in a legally binding way. By accessing or using our Website, you are automatically agreeing to these Terms, regardless of whether you have read them or not. If you do not agree to our Pricing Terms and Conditions, you should not use our Website. It is your responsibility to read, understand, and agree to these Pricing Terms and Conditions before using our Website.

These Pricing Terms and Conditions are part of and incorporated into the overall Terms of Snap Crackle and Boom Fireworks. In the event of any conflict between these Pricing Terms and Conditions and the overall Terms, the latter shall prevail.

Interpretations and Definitions

Interpretation

The words of which the initial letter is capitalized have meanings defined under the conditions specified in the below “Definitions” section. The following definitions shall have the same meaning regardless of whether they appear in singular or plural.

Definitions

For the purposes of this Pricing Terms and Conditions:

• Company (“Snap Crackle and Pop”, “Snap Crackle and Boom”, “the Company”, “We”, “Us”, or “Our”) refers to Snap Crackle and Pop Fireworks LLC, d/b/a Snap Crackle and Boom Fireworks.
• You or User(s) means the individual(s) accessing the Website or Service or the company or other legal entity on behalf of which such individual is accessing or using the Website, if applicable.
• Website or Site refers to the following site: https://www.scbfireworks.com/, and all of its affiliated pages, Policies, and Disclaimers.

Pricing Differences

Prices shown online may not reflect the exact price at our stand locations. We often run special offers in all or some locations. Prices may also vary from one location to another, including stand pricing. If there is a pricing discrepancy, we reserve all rights to correct the issued price if we notice that there could be an error. If you believe there to be an error in our pricing, reach out to us at the below-provided contact information.

Fees, Returns, Refunds, and Payment for Purchased Products

You are required to pay all fees specified on all order forms, except as otherwise specified herein or in an order form. Fees may be charged if you order fireworks online and do not pick up your order without providing us reasonable notice of your order cancellation. If you do not pick up your order within seven (7) days of your scheduled pickup date (or by the end of the fireworks selling season, whichever is sooner), we will refund your transaction, less a handling or restocking fee of up to 15% or as pursuant to state law.  THERE ARE NO REFUNDS OR RETURN ON PICKED UP PRODUCTS BY YOU.  However, we will provide You with a store credit for any damaged or “dud” product. To be provided store credit, you must provide us a photo and/or video of the damaged firework and its inability to properly function. Please do NOT return the product to our store. We ask that you promptly and properly dispose of the damaged firework.

Invoicing and Payment

Payment is due at the time of purchase. You will provide Company, with valid and updated credit card information or with a valid purchase order or alternative document reasonably acceptable. If you provide credit card information, you authorize Company to charge such credit card for all Services or Products listed on the Order Form for the initial purchase term and any term(s) entered in accordance with the provisions as set out in the Terms of Service.

Taxes

Unless otherwise stated in writing or required by state or local law, regulation, or ordinance, Company’s products do not include any taxes, levies, duties, or similar governmental assessments of any nature, including but not limited to value-added, sales, use, or withholding taxes, assessable by any local, state, provincial, federal, or foreign jurisdiction (collectively, “Taxes”). You are responsible for paying all taxes associated with your purchases.

Specials and Coupons

Purchase prices pursuant to specials and coupons are shown before tax. See a sales associate in-store for complete details on all offers. Quantities may be limited on items. We reserve the right to substitute items of equal or greater value if we run out of product. We make all efforts to provide accurate information but reserve the right to correct typographical or pricing errors should they occur. Specials and coupons cannot be combined with any other offer or discount. Void where prohibited by law.

Discounts

We offer an 11% discount to all military personnel and veterans across all of our locations, in-person, with a valid form of ID. If a person qualifies for multiple discounts, we will not stack discounts, but that person will have the option of choosing between the discounts.

Giveaways

Our giveaways are our way of showing our gratitude and appreciation to our customers. Every season, we give away many different items at various price points, including but not limited to fireworks or cash awards.

Limitation of Liability on Pricing

The Company shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with these Pricing Terms and Conditions, including but not limited to pricing errors or product availability.

Payments are processed through secure third-party providers, Square and PayPal. We rely on these providers for additional security measures.

Changes to These Terms and Conditions

We may update these Pricing Terms and Conditions at any time, provided that we will give you at least 30 days’ notice of any significant changes. We will notify you of any changes by posting the new Pricing Terms and Conditions on this Webpage and updating the “Last Update” date that is at the top of this Pricing Terms and Conditions.
