Our Acceptable Use Policy covers the products, services, and technologies (collectively referred to as the “Products”) provided by Snap, Crackle, & Boom Fireworks under any ongoing agreement. It is designed to protect us, our customers, and the general Internet community from unethical, irresponsible, and illegal activity.
Engaging in activities that are prohibited by this Policy creates liability for suspension of all services, including sales, and termination of client accounts. In extreme cases, we may be required to report such customers to the relevant law enforcement.
By accepting Products from us, You agree to the terms of this Policy on behalf of yourself and you are responsible for ensuring that anyone using the Products as their end users are aware and comply with this Policy. Complaints regarding the actions of customers or their end users will be forwarded to the nominated contact for the account in question. However, we will provide you with an opportunity to respond to these complaints before taking any action.
Interpretation and Definitions
Interpretation
The words of which the initial letter is capitalized have meanings defined under the conditions specified in the below “Definitions” section. The following definitions shall have the same meaning regardless of whether they appear in singular or plural.
Definitions
For the purposes of this Acceptable Use Policy:
- Company (“Snap Crackle and Pop”, “Snap Crackle and Boom”, “the Company”, “We”, “Us”, or “Our”) refers to Snap Crackle and Pop Fireworks LLC, d/b/a Snap Crackle and Boom Fireworks.
- You or User(s) means the individual(s) accessing the Website or Service or the company or other legal entity on behalf of which such individual is accessing or using the Website, if applicable.
- Website or Site refers to the following site: https://www.scbfireworks.com/, and all of its affiliated pages, Policies, and Disclaimers.
Fair Use
We offer our Products only under the understanding that Your use will be “business as usual”, as reflected in our Offer Schedule. If your use is considered to be excessive, dangerous, or harmful in any way, additional fees may be charged, or capacity of purchase may be implemented on your purchase or future purchases. We will provide clear guidelines on what constitutes an excessive, dangerous, or harmful order, based on factors including but not limited to volume of purchase, frequency of purchase, and potential safety risks.
We are expressly opposed to abuse, discrimination, rights infringements, and/or actions that harm or disadvantage any group, individual, or resource in all their forms. We expect our customers and, to the fullest extent, their users (“end-users”) to likewise engage with our Products with similar intent.
Customer Accountability
YOU ARE RESPONSIBLE FOR YOUR OWN ACTIONS AS WELL AS THE ACTIONS OF ANYONE USING OUR PRODUCTS WITH YOUR PERMISSION OR UNDER YOUR SUPERVISION. This responsibility also applies to anyone using our Products on an unauthorized basis as a result of Your failure to put in place reasonable precautions and security measures.
If You, Your end-user, or anyone using our Products as a result of You violates this Acceptable Use Policy, We reserve the right to terminate any Products associated with the offending account or the account itself or take any remedial or preventative action we deem appropriate without notice. To the extent permitted by law, no credit will be available for interruptions of service resulting from any violation of our Acceptable Use Policy.
In addition, any violations of this Acceptable Use Policy may result in actions including, but not limited to, suspension or termination of services, fines, and legal action. We will notify you in writing of any actions taken and provide an opportunity to remedy the violation if applicable.
User Conduct
Users are expected to interact with our Website and other users in a respectful and lawful manner. Prohibited behaviors include, but are not limited to, harassment, hate speech, abusive language, and any actions that are intended to harm or intimidate others.
If you become aware of any violation of this Acceptable Use Policy, please report it immediately to us at the contact information provided below. When reporting a violation, please provide as much detail as possible to assist us in our investigation.
Security Obligations
Users must take all reasonable steps to ensure the security of their accounts and data. This includes using strong passwords, keeping login credentials confidential, and promptly reporting any security breaches or suspicious activity to us.
Prohibited Activities: Copyright Infringement
OUR PRODUCTS MUST NOT BE USED TO TRANSMIT, DISTRIBUTE, OR STORE ANY MATERIAL THAT IS IN VIOLATION OF ANY STATE OR FEDERAL LAW including but not limited to:
- Any copyright, trademark, patent, application of the same, trade secret, or other intellectual property owned and protected by us or a third party; and
- Any material, content, or post that a reasonable person would deem to be obscene, defamatory, constitute a threat, or violates export control laws.
You are solely responsible for all material, content, posts, or payment that you input, upload, disseminate, transmit, create, and/or publish through or on our Products. You are solely responsible for obtaining legal permission to use any previously listed works.
Spam and Unauthorized Message Activity
We take our customers’ privacy seriously and work hard to protect our supportive customers. Our products and services (“Products”) must not be used for the purpose of sending unsolicited bulk or commercial messages in violation of the laws and regulations applicable to your jurisdiction (“Spam”). This includes but is not limited to sending Spam, soliciting customers from Spam sent from other service providers, and collecting replies to Spam sent from other service providers.
Our Products must not be used to run unconfirmed mailing lists or telephone number lists (“Messaging Lists”). This includes but isn’t limited to subscribing email addresses or telephone numbers to any Messaging List without the permission of the email address or telephone number owner and storing any email addresses or telephone numbers subscribed in this way. All Messaging Lists run on or hosted by our Products must be “confirmed opt-in”. Verification of the address or telephone number owner’s express permission must be available for the lifespan of the Messaging List.
We expressly prohibit the use of email lists, telephone number lists, or databases purchased from third parties intended for Spam or unconfirmed messaging list purposes on our Products. This Spam and unauthorized message activity policy applies to messages sent using our Products, or to messages sent from any network by the customer or any person on the customer’s behalf, that directly or indirectly refers the recipient to a site hosted via our Products. Violations of this policy may result in immediate suspension or termination of access to our Products, at our discretion, following written notice to the customer and a reasonable opportunity for the customer to remedy the violation.

Unethical, Exploitative, and Malicious Activity
Our Products must not be used for the purpose of advertising, transmitting, or otherwise making available any software, program, product, or service designed to violate this Acceptable Use Policy, or the Acceptable Use Policy of our service providers. Such examples include but are not limited to facilitating the means to send spam and the initiation of network sniffing, pinging, packet spoofing, flooding, mail bombing, and denial-of-service attacks.
Our Products must not be used to access any account or electronic resource where the group or individual attempting to gain access does not own or is not authorized to access the resource (e.g. “hacking”, “cracking”, “phreaking”, etc.).
Our Products must not be used for the purpose of intentionally or recklessly introducing viruses or malicious code into our Products and systems. Our Products must not be used for purposely engaging in activities designed to harass another group or individual. Our definition of harassment includes but is not limited to denial-of-service attacks, hate speech, advocacy of racial or ethnic intolerance, and any activity
intended to threaten, abuse, infringe upon the rights of, or discriminate against any group or
individual.
These activities go against our Company mission and will not be tolerated.
Other activities considered unethical, exploitative, and malicious include:
- Obtaining (or attempting to obtain) services from us with the intent to avoid payment;
- Using our facilities to obtain (or attempt to obtain) services from another provider with the
- intent to avoid payment;
- The unauthorized access, alteration, or destruction (or any attempt thereof) of any
- information about our customers or end-users, by any means or device;
- Using our facilities to interfere with the use of our facilities and network by other customers
- or authorized individuals;
- Publishing or transmitting any content or links that incite violence, depict a violent act,
- depict child pornography or threaten anyone’s health and safety;
- Any act or omission in violation of consumer protection laws and regulations; and
- Any other violation of a person’s privacy.
Our Products may not be used by any person or entity, that is involved with or suspected of involvement in activities or causes relating to illegal gambling; terrorism; narcotics trafficking; arms trafficking; the proliferation, development, design, manufacture, production, stockpiling, or use of nuclear, chemical, or biological weapons, weapons of mass destruction, or missiles; in each case including any affiliation with others whatsoever who support the above such activities or causes.
Unauthorized Use of Our Property
There is nothing in this Policy or any of our affiliated website policies, disclaimers, or terms and conditions that create a partnership, joint venture, or business relationship of any kind between You and the Company. The representation of any type of significant business relationship with Us is expressly prohibited.
The impersonation of Our fireworks and other products or the false representation of ownership of any of our property (each of these includes our Products and our brand) for the purpose of financial gain is fraudulent and expressly prohibited.
Data Protection and Privacy
We are committed to protecting your privacy and handling your data in a transparent manner. Our Privacy Policy outlines how we collect, use, store, and protect your personal information. By using our Products, you also agree to comply with all applicable data protection laws, including but not limited to GDPR and CCPA. You must ensure that any data you collect, process, or store through our Products is handled in accordance with these laws.
Changes to This Policy
We may update this Acceptable Use Policy from time to time. We will notify you of any changes by posting the new Acceptable Use Policy on this Webpage and updating the “Last Update” date that is at the top of this Acceptable Use Policy. Changes will take effect 30 days after they are posted.
